The legislative decree no. 234 of 22nd of December 2017, published on the Official Journal n. 38 of 15th of February 2018, has introduced new guidelines on protection of citizens of EU member states unrepresented in a third country.
According to the new discipline, a EU member State, if requested, has to provide consular assistance to EU citizens unrepresented in that State, and to their family even if not EU citizens, in the following situations:
• Arrest or detention;
• Being a victim of crime;
• A serious accident or serious illness;
• Death;
• Relief and repatriation in case of an emergency;
• A need for emergency travel documents as provided for in Decision 96/409/CFSP.
